Migration requirements in Azerbaijan

Fines imposed by the State Migration Service:

 

A fine of 300-400 AZN is imposed for violating the rules of being, living and working as a foreigner in the Republic of Azerbaijan. In some cases, a decision to remove (deport) within the borders of the country can be applied administratively.

 

Registration upon place of stay

 

The period of temporary stay of foreigners arriving on the basis of a visa cannot exceed the period of stay specified in the visa, and foreigners arriving without a visa can not exceed 90 days.

 

Foreigners or stateless persons temporarily staying in the Republic of Azerbaijan for more than 15 days must be registered at their place of residence.

 

Residence permit in Azerbaijan

Residence permit  (RP) in Azerbaijan is one of the frequently asked questions of our clients. We inform all our potential clients about the need to find the right solution for these issues, because the correct documentation is important from the beginning of the processes, especially the type of entry visa to Azerbaijan and the necessary documents that foreigners should bring with them to Azerbaijan when applying for a temporary or permanent residence permit.

 

Foreigners and stateless persons intending to live temporarily in the territory of the Republic of Azerbaijan must obtain a relevant permit and a temporary residence permit card from the State Migration Service of the Republic of Azerbaijan. A temporary residence permit (TPR) is a document that allows foreigners and stateless persons in the territory of the Republic of Azerbaijan to temporarily live in the Republic of Azerbaijan, as well as to leave the Republic of Azerbaijan and return to the Republic of Azerbaijan without a visa during its validity period. In addition, the temporary residence permit confirms the foreigner’s identity and place of residence in Azerbaijan. In the temporary residence permit, the foreigner is given a FIN code, which allows him to carry out possible legal transactions in banks.

 

Foreigners and stateless persons are allowed to temporarily live in the Republic of Azerbaijan in the following cases:

 

  • If they are close family members of an Azerbaijani citizen. Parents and children, grandparents and grandchildren, siblings with common parents are considered close relatives by law;
  • If they have real estate worth at least 100,000 manats (AZN) in Azerbaijan or funds of the same amount in Azerbaijani banks; in such cases, the price of real estate in Azerbaijan is assessed by independent appraisal agencies, and the real contract price of real estate is not considered by the authorities;
  • Economy, industry, defense, science, culture, sports, etc. if they are highly qualified specialists in the fields;
  • Foreigners and stateless persons are allowed to live temporarily in the Republic of Azerbaijan in the following cases:
  • If they hold the position of head or deputy head of a company registered in Azerbaijan and owned by a foreign person, or if they hold such positions in a branch or representative office of a foreign legal entity in the Republic of Azerbaijan;
  • If they invest at least 500,000 manats (AZN) in the economy of Azerbaijan;
  • If they are engaged in entrepreneurial activity in the Republic of Azerbaijan; it is accepted as a basis for granting a temporary residence permit only in the territory of the Republic of Azerbaijan, where at least 5 people (full-time) or 10 people (part-time) work through this entrepreneurship. In this case, at least 80 percent of employees must be citizens of the Republic of Azerbaijan;
  • To carry out paid labor activities in the territory of the Migration Code of the Republic of Azerbaijan, if they have received a permit to work in Azerbaijan;
  • If they have received full-time education in higher educational institutions (universities) and technical schools (vocational colleges), as well as secondary schools of the Republic of Azerbaijan;
  • If there are grounds stipulated in the international agreements of the Republic of Azerbaijan

 

In practice, small business owners are usually granted a temporary residence permit for 3 to 6 months. The temporary residence permit is issued on the appropriate working day according to the fee after submitting all the necessary documents together with the application form.

It should be noted that unlike some other foreign countries, the applicant’s citizenship does not change the legal requirements or procedures for immigration purposes, i.e. whether the applicant is from Eastern countries such as Pakistan, India, Iran, Iraq or European countries such as England, Italy, Germany does not change the legal procedures. .

 

 

Obtaining a permanent residence permit (PRP)

 

A permanent residence permit may be issued after a continuous stay of at least 2 years on the basis of temporary residence, provided that there are grounds for this. In addition, the applicant applying for permanent residence in Azerbaijan must pass an exam on his knowledge of the Azerbaijani language and certain migration rules by a special commission at the State Migration Service.

 

Obtaining citizenship in the Republic of Azerbaijan

A foreigner and a stateless person who has lived permanently on the territory of the Republic of Azerbaijan for the last five years on a legal basis, has a legal source of income, undertakes to comply with the Constitution and laws of the Republic of Azerbaijan, as well as submits a document of knowledge of the state language of the Republic of Azerbaijan. Regardless of his affiliation, gender, education, religious attitude, political and other beliefs, he can be accepted as a citizen of the Republic of Azerbaijan by his own petition in accordance with this law.
